How many states legalize same sex marriage?

I’m doing a research paper but I can’t get a straight answer (haha).
Some sites say 2 states some say 3, but I’m not sure how many really legalize marriage, not just civil unions.

To be technically accurate no state in the United States has actually “legalized” same sex marriages. What happened in Massachusetts is a high ranking judge reinterpreted the existing laws on marriage to include same sex couples. Then the courthouses were ordered to start issuing marriage licenses to homosexuals and the state began to recognize same sex marriages. However no laws were actually “changed” in the process to legalize it. It was treated as if it had always been legal.

New Jersey, I believe, has legalized same sex civil unions but not same sex marriages. And California had a referendum on the ballot in last year’s election to legalize same sex marriages, but it failed.
